By accessing or using VKGames (the "Platform"), including its AI workspace, any registered account features, and all associated subdomains (collectively, the "Service"), you agree to be legally bound by these Terms of Service ("Terms").

VKGames is a web-based platform that provides free, browser-based access to open-source large language models (LLMs). The Platform enables users to run inference on publicly available AI model weights without requiring proprietary API access or paid subscriptions.
The Service also includes a content section where the team publishes posts on topics related to the AI models hosted, the open-source ecosystem, and technical subjects of interest. These posts are informational in nature and are secondary to the core model-access functionality.

The Platform's design, interface, code, branding, and editorial content (blog posts) are the intellectual property of the VKGames team and are protected by applicable copyright law. You may not reproduce, distribute, or create derivative works from our proprietary content without prior written permission.
The AI models made available through the Platform are open-source and governed by their respective licences (e.g. Meta Llama Community Licence, Apache 2.0, Mistral AI Terms). Your use of model outputs may be subject to those licences. It is your responsibility to verify compliance for commercial use cases.
If you submit any content to the Platform (e.g. feedback, contact form messages), you grant us a non-exclusive, royalty-free licence to use that content for the purpose of responding to you or improving the Service. You retain all ownership rights over content you submit.
You represent that any content you submit does not infringe the intellectual property rights or privacy rights of any third party.
The Platform may contain links to external websites or services not operated by us. We have no control over the content, privacy policies, or practices of third-party sites and accept no responsibility for them. We encourage you to review the terms and privacy policy of any third-party site you visit.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected. Access to AI models may be temporarily unavailable due to maintenance, updates, or infrastructure issues.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE VKGAMES TEAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total cumulative liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or USD $10, whichever is greater.
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, including but not limited to violation of these Terms. You may delete your account at any time.
Upon termination, all provisions of these Terms that by their nature should survive will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms are governed by and construed in accordance with applicable international law. Any dispute arising from these Terms will be resolved through good-faith negotiation. If a resolution cannot be reached informally, disputes shall be submitted to competent jurisdiction.

Your continued use of the Service after any modification constitutes acceptance of the revised Terms. For significant changes, we will endeavour to provide notice through the Platform.
